LB Phillips won't face charges

    Chargers linebacker Shaun Phillips will not face charges stemming from an incident at a downtown rooftop bar in April.

    The San Diego City Attorney's Office said Tuesday it has declined prosecution.

    “There was not enough evidence to support a good faith belief that we would have been able to convict beyond a reasonable doubt,” said Gina Coburn, spokeswoman for the city attorney.

    A security guard at the Ivy Hotel said Phillips hit him in the face, according to San Diego police. The guard placed him under citizen's arrest, and police cited him for misdemeanor battery.

    Phillips denied it. After the incident, he said: “It was somebody else's mishap. It had nothing to do with me or my teammates.”

    It was the third time Phillips, 28, has had a run-in with the law downtown since 2006. Each time he has been cleared afterward for lack of evidence.

    Also in April, a security guard at Stingaree on Sixth Avenue said Phillips choked and punched him at the club. Phillips was named as a suspect but not arrested or cited, police said. The owner of Stingaree later said the security guard recanted his statement to police that he was assaulted.

    In April 2006, Phillips was arrested after an altercation with police in the Gaslamp Quarter. An officer subdued Phillips after seeing him in an apparent fight with a woman, according to police. In the ensuing struggle, one officer was bitten and another suffered minor injuries, police said.

    The District and City Attorney's Offices declined to file charges after reviewing the case.
